The Invention

From a legal point of view, an invention provides a new solution to a technical problem.

An invention can be a product, the use of a product, an application of a product, a chemical compound, a treatment, a kit, or a process.

An invention can be protected by a patent only if it satisfies the following criteria:

  • The invention must be novel: If it has been published or described (written or oral) before or used publicly (internet forum, exhibition etc.) or disclosed to third parties without confidentiality agreement, this criterion is not fulfilled.

  • The invention must be innovative. It shall not be obvious for a person skilled in the art and shall not be deduced from the technical field of the invention.

  • The invention must have an industrial application.
